Welcome to the official Terms of Service ("ToS") for Pokémon#8738 Bot. Please read these terms carefully before using our Discord bot and the associated website. By accessing or using the bot and the website, you agree to abide by these terms.

1. Acceptance of Terms

By using Pokémon#8738 Bot, you signify your agreement to these terms of service. If you do not agree to these terms, you may not access or use the bot.

2. Description of Service

Pokémon#8738 Bot is a Pokémon-themed bot designed for entertainment purposes on the Discord platform. Users can engage in Pokémon-themed activities, trades, and games.

3. User Responsibilities

Users are expected to follow the rules outlined below:

Trade Restrictions: Any trade involving real-world monetary value, such as Discord Nitro or real money, is strictly prohibited. Users are also forbidden from trading Pokémon, credits, or features related to Pokémon#8738 Bot for currency, items, or features from other bots. Engaging in such activities will result in a permanent ban.

NOTE: Trading Pokémon or credits from this bot for real-world items, Nitro Classic/Boost, or any other external item is strictly forbidden. Violation will lead to an immediate ban from the server and a blacklist from the bot.

Alternate Accounts: Alternate accounts, or "alts", are not permitted in the server. This is in compliance with Discord's official Terms of Service.

Auction Limitations: Once a Pokémon is placed for auction, it cannot be withdrawn. Additionally, bids placed in an auction are final and cannot be retracted.

Gamble Advisory: We are not responsible for any losses incurred during gambling or betting activities in the bot.

Scams and Loans: We are not responsible for scams or loans between players. All trades and exchanges between users are done at their own risk. We strongly recommend using only the official trade commands provided by the bot. Any unofficial transfers, loans, or "trust trades" are not protected or recoverable.

Lost Items Due to Account Issues: If you give your items, Pokémon, or currency to another player and their account gets banned, reset, deleted, or they lose access to their Discord account for any reason, we are not responsible for recovering your items. All transfers are final and at your own risk.

Bug Reporting: If users discover any bugs or glitches in Pokémon#8738 Bot, they are required to report them directly in the "bug-reports" channel. Exploiting known bugs for personal gain will result in a reset of the violating account and a permanent ban from both the server and the bot.

Autocatcher Prohibition: Usage of autocatchers with Pokémon#8738 Bot is prohibited. Detection will lead to account resets and permanent bans.

Discord's Terms and Guidelines: We abide by Discord's ToS and community guidelines. Therefore, using auto spammers or self-bots to gain an unfair advantage will result in a permanent ban.

4. Suspicious Activity

We reserve the right to monitor and investigate any suspicious activities related to our bot or services. If we believe a policy violation or illegal activity has occurred, we will take necessary actions. This may include creating an invite link to your server and joining the server for investigation. We are not obligated to disclose our methods for identifying misuse or suspicious activity.

5. Use License

Permission is granted to use the Bot for personal, non-commercial transitory viewing only. This is a grant of a license, not a transfer of title. You may not:

Modify or copy the materials;
Use the materials for any commercial purpose, or for any public display;
Remove any copyright or other proprietary notations;
Transfer the materials to another person or "mirror" the materials on any other server.

6. Intellectual Property and Image Usage Rights

Pokemon Images and Custom Skins

Standard Pokemon Images: Third-party bots and websites may use standard base Pokedex Pokemon images without requiring our permission, as these are publicly available resources.
Custom Pokemon Skins: Our custom Pokemon skins are proprietary intellectual property of Pokémon#8738 Bot. These custom designs, modifications, and unique artwork are protected by copyright law.
Prohibited Use: Using our custom Pokemon skins in any third-party bot, website, application, or service without explicit written permission from our team is strictly prohibited.
Legal Action: Unauthorized use of our custom Pokemon skins will be considered copyright infringement. We reserve the right to take legal action against any individual or entity that uses our custom content without permission, including but not limited to:
- Issuing cease and desist notices
- Filing DMCA takedown requests
- Pursuing legal damages and compensation
- Seeking injunctive relief

Under no circumstances shall Pokémon#8738 Bot, its developers, or administrators be liable for:

Any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the bot
Any loss of items, Pokémon, or currency due to user-to-user transactions, scams, or loans
Any loss resulting from account bans, resets, or lost access to Discord accounts
Any loss of data or virtual items for any reason
Any damages resulting from unauthorized access to or alteration of your transmissions or data
Any conduct or content of any third party using the bot

You acknowledge that all transactions and interactions with other users are at your own risk.
